Conditions for Approval of Bank Guarantee Wording Deviations
Any requested modifications to the standard Bank Guarantee wording may be considered, but are subject to a two-tier approval process:
-
Internal Review and Approval:
Our dedicated compliance and legal teams will conduct a thorough examination to ensure that any deviations align with Balkan Capital Assets’ internal risk management policies, regulatory requirements, and best market practices. This step ensures that changes do not expose the institution or its clients to undue risk or legal ambiguity. -
Issuing Bank Formal Approval:
Following internal clearance, the proposed wording amendments must receive formal authorization from the designated Issuing Bank. The bank will evaluate the changes based on their own risk assessment frameworks and operational guidelines, ensuring consistency with international banking standards and regulatory compliance.
It is important to note that any deviation from the standard wording must be fully reconciled with both internal risk protocols and prevailing market conventions to maintain the integrity and enforceability of the Bank Guarantee. This rigorous approval process guarantees that all parties’ interests are protected and that the instrument remains legally robust.
